Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (JITIS – Jakob IT und Informationssicherheit, Owner: Jonas Jakob, Karl-Stieler-Straße 18, 93051 Regensburg, Germany, telephone: +49 941 99227246, email: info@jitis.io) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at https://jitis.io/en/widerruf. If you use this online function, we will send you, on a durable medium (for example, by email), an acknowledgement of receipt without delay, with information on the content of the withdrawal statement and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the performance of services should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Special information – supplementary information (not part of the model withdrawal instructions)

The statutory right of withdrawal is available only to consumers within the meaning of section 13 BGB and applies, subject to the statutory conditions, to distance and off-premises contracts for services.

For a service contract requiring you to pay a price, the right of withdrawal expires under section 356(5), point 2 BGB once the service has been fully performed, provided that, before performance began, you expressly consented to us starting before the withdrawal period ended and acknowledged that you would lose your right of withdrawal upon our full performance of the contract. For an off-premises contract, you must have transmitted that consent on a durable medium. Starting the service alone does not extinguish the right of withdrawal.

For a service contract that does not require payment of a price, the right of withdrawal expires upon full performance under section 356(5), point 1 BGB. Where a right of withdrawal exists for an expressly requested repair visit, its early expiry is governed by section 356(5), point 3 BGB. For expressly requested urgent repairs, section 312g(2), point 11 BGB may exclude that right; additional services must be assessed separately.

Under section 357a(2) BGB, proportionate payment requires, in particular, your express request for performance to begin before the period ends and the provision of the proper statutory information; for off-premises contracts, that request must also be transmitted on a durable medium.
